1. General conditions of sale

These General Conditions of Sale, hereinafter “General Conditions”, are drawn up in compliance to the legislative provisions of the Civil Code, Legislative Decree no. 70 of 04.09.2003 regarding services of the information society and electronic commerce and to Legislative Decree no. 206 of 06.09.2005, so-called Consumer Code, and, in particular, in Chapter I of Title III of Part III, articles 45 to 67, and govern the offer and sale of products via the website www.gaelle.it, below the “Site”.

Branded products Gaëlle Paris® marketed on the Site, hereinafter the "Products", also in the singular declension, they are sold by Dream Project S.p.A., based in Via Forcella, 3 – 20144 Milan (MI), C.C.I.A.A. of Milan Monza Brianza Lodi at no. REA 2125635 of the Registry of Companies, C.F. and VAT no. 06971910721, owner of the Site.

2. Intellectual Property, Software and Content

The contents of the Site, such as, by way of example, works, images, photographs, dialogues, music, sounds, videos, documents, drawings, figures, logos and any other material, in any format, published on the Site, including menus, web pages, graphics, colors, schemes, tools, fonts, website design, diagrams, layouts, methods, processes, functions and software are protected by copyright and all other intellectual property right.

Reproduction, in whole or in part, in any form, of the Site and its contents is prohibited without the consent expressed in writing by the Manager or other holders of the relevant rights.

Regarding the use of the Site, the user is only authorized to view the website and its contents. He is also authorized to carry out all temporary acts of reproduction, without economic significance own, considered transitory or accessory, an integral and essential part of the display of the Site and its contents, as well as all other navigation operations performed only for legitimate use of the Site and its contents.

No reproduction, on any medium, in whole or in part, of the Site and its is authorized contents. Any act of reproduction must be authorized by the Manager or, where necessary, by the authors of the individual works contained in the website or by the owners of the exploitation rights.

These operations must be carried out for lawful purposes and in compliance with copyright and other rights intellectual property rights of the Manager and the authors of the individual works contained on the website. The authors of individual works published on the Site have, at any time, the right to claim the authorship of their works and to oppose any deformation, mutilation or other modification of them works themselves, including any act to the detriment of the works which is prejudicial to their honor or theirs reputation.

The user undertakes to respect the copyright of the artists who have chosen to publish theirs works on the Site or who have collaborated with the Site in the creation of new expressive and artistic forms. You are under no circumstances authorized to use, in any way or form, the contents of the website and any single work protected by copyright and any other intellectual property right.

2.1 Acceptance of the general conditions of sale and conclusion of the contract

2.1.1

The contract stipulated between Dream Project S.p.A., hereinafter "Dream Project", and the Customer, i.e. the subject, natural person, who makes a purchase on the Site for purposes not related to their commercial activity, entrepreneurial or professional, must be considered concluded with the acceptance, even if only partial, of the order by Dream Project. In case of non-acceptance of the order, Dream Project will provide it timely communication to the Customer.

2.1.2

By placing an order in the various ways provided, according to the order form on the Site, below the "Order", the Customer declares to have read all the information provided during the procedure of purchase and to fully accept these general conditions, hereinafter the "Conditions".

2.1.3

These Conditions may be printed or saved on a durable medium, in compliance with the provisions from the art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

2.1.4

The products offered for sale by Dream Project are solely those present on the Site at the time of submission of the Order, as described in the relevant information sheets.

2.1.5

The images accompanying the description of a product are for informational purposes only and may not be perfectly representative of its characteristics, differing for example in color and size, also due to the browser and monitor used to access the Site.

2.1.6

To place an Order, the Customer must complete the relevant form in its entirety on the Site and send it after having carefully read the Conditions, as well as the characteristics of the product or products that you intend to purchase. The Customer must also request Dream Project, where desired, to issue tax invoice relating to the purchase, pursuant to art. 22 Presidential Decree n. 633/1972.

2.1.7

The correct receipt of the Order is confirmed by Dream Project by means of a response sent via e-mail to the email address communicated by the Customer. This confirmation message will summarize the purchase conditions, as well as the data entered in the Order by the Customer.

3. Prices and payment methods

The prices indicated on the Site are to be considered inclusive of taxes and VAT. Any costs shipping or payment costs are communicated in advance to the Customer through the Site or these Conditions.

3.1 Payment methods

• PayPal: the Customer can use the PayPal circuit according to its specific methods.
• Credit or debit card: the transaction can take place through the secure PayPal server or other secure server chosen by Dream Project.
• Afterpay, only for Italy: Payment in installments is possible through the provider Afterpay. Minimum order €5, maximum order €1,500.

Under no circumstances will Dream Project be able to know your credit card information Customer, transmitted via secure connection directly to the website of the banking institution that manages the transaction.

4. Right of withdrawal

4.1

Pursuant to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the purchase contract within 14 days from the date of receipt of the products, without necessity to provide reasons and without any penalty.

4.2

To exercise the right of withdrawal, the Customer must use the appropriate form present in the package received and send the package to a Post Office or PuntoPoste.

4.3 Return procedure

In case of withdrawal, the Customer must send a return authorization request via email to customercare@gaelle.it or via WhatsApp chat at the address 353 37 05 737, indicating the order number.

Once the authorization and the prepaid label have been received, it will be possible to proceed with the free return of the items products by sending them to:

Each item purchased comes complete with a special security seal. Once the seal is removed, the boss is no longer considered eligible for return. Only items with the seal still intact will be accepted.

The goods must be returned intact, complete with all its parts and in the original packaging, without signs of wear or dirt. It is possible to request a return for an exchange of size and/or color only. It's not It is possible to request a replacement with different products.

It is not possible to return an item purchased online in store.

4.4 Refund

Dream Project will refund the Customer the entire amount already paid, net of any costs additional shipping costs, within 30 days from the date of receipt of the item, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed.

Dream Project may suspend the refund until receipt of the returned product or until such time in which the Customer demonstrates that he has correctly returned the product.

4.5 Forfeiture of the right of withdrawal

The Customer will lose the right of withdrawal in cases where Dream Project ascertains that the returned product, its accessories or packaging are not intact, or the product is missing its packaging external, the original internal packaging or integral elements and accessories.

In the event of forfeiture of the right of withdrawal, Dream Project will return the product to the sender purchased, charging the shipping costs and, where already refunded, the price of the product.

4.6 EU and non-EU returns

For all EU orders the first return is free. The Customer must return the goods within 14 days from the date of receipt of the products. Only the first return and/or exchange is free size/color.

For all non-EU orders, the goods can be sent back with costs borne by the end customer, by choosing the courier and preferred shipping method. In case of returns coming from non-EU territories, any duties and charges relating to the customs clearance procedure will be deducted from the total refund amount. Size/color changes are not possible.

5. Guarantees

All products sold by Dream Project are covered by the warranty 24 months for defects of compliance, pursuant to Title III of Legislative Decree 206/2005. To benefit from warranty assistance, the Customer must keep the invoice, or the payment receipt, together with the transport document.

The warranty will apply as long as the product has been used correctly, in compliance with its intended use and as provided in the use and washing instructions present in and/or with the product.

If Dream Project is unable to return to the Customer a product under warranty, restored or replaced, you will be able to proceed with an appropriate reduction in the price paid or with a refund of the entire amount amount paid upon termination of the contract.

In cases where the application of the guarantees requires the return of the product, this must be the case returned by the Customer in the original packaging, complete in all its parts.

7. Privacy

The personal data collected when placing the Order will be processed by Dream Project for the sole purpose of satisfy the express requests of the Customer, in compliance with European Regulation 679/2016 and the information privacy present on the Site. Any further processing will be carried out only by express consent of the Customer.

8. Applicable law

The sales contract referred to in these Conditions and its execution are governed by law Italian, with the disapplication of the conflict rules and the United Nations Convention for International Sale of Goods. The Court will be competent to resolve the related disputes of the municipality of residence of the Customer.
